RxPHARMACIST PRIVACY POLICY
1. Introduction
This Privacy
Policy (“Policy”) describes the types of information RxPharmacist, LLC
(“RxPharmacist,” “we,” “us,” or “our”) may collect from you or that you may
provide when you use our website (rxpharmacist.com), online course platform,
study materials, continuing education tools, and all other interactive
features, tools, and communications provided by RxPharmacist, however accessed
and/or used (collectively, the “Services”). This Policy also describes our
practices for collecting, using, maintaining, protecting, and disclosing that
information.
Please read
this Policy and our posted Terms of Service (together with this Policy, the
“Terms”) before you use our Services. By using the Services, you represent and
warrant that you are of legal age to form a binding contract with us and agree
to be bound and abide by our Terms. If you do not agree to all of our Terms, or
if you violate them in any way, you may not access or use the Services.
We are
strongly committed to letting you know how we will collect and use your
personal information, and this Policy describes those practices in detail. This
website and our Services are directed to residents of the United States. If you
are located outside of the United States, please do not submit personal
information through our Services; all data processing occurs in the United
States.
2. What is Personal Information?
This Policy
applies to Personal Information collected or used by RxPharmacist in connection
with its Services. “Personal Information” generally means any information that
enables us to identify you, directly or indirectly, by reference to an
identifier such as your name, identification number, location data, online
identifier or one or more factors specific to you. Personal Information can
include “Sensitive Personal Information” (particularly sensitive types of
Personal Information) and “Pseudonymised Personal Information” (information
that does not identify you directly but can be linked to other information that
does). Personal Information does not include de-identified information, meaning
information that (1) cannot reasonably be used to infer information about, or
otherwise be linked to, an identified or identifiable individual, (2) that
RxPharmacist publicly commits to maintain and use only in de-identified form,
and (3) for which recipients are contractually prohibited from attempting to
re-identify.
3. How We Collect Personal
Information
As described
further below, we may receive Personal Information through many aspects of our
online Services, and we may collect such information about you by various
means, including:
•Directly from you, through our website, online course
platform, and email or other direct contact with us;
•From your educational institution, such as when a
pharmacy school directs you to use RxPharmacist services or when score
reporting is requested;
•From third party sources, such as social media
platforms that you may use to engage with us;
•Through cookies and similar technologies used on our
website, which collect technical information regarding your use of and activity
on our Services.
4. What Information Do We
Collect?
RxPharmacist
may collect the following types of Personal Information:
a. Information Provided to
RxPharmacist
You may
provide Personal Information to us which may include your name, email address,
postal address (for print study guide orders), phone number, and if you are
making a purchase, your payment information (e.g., credit card). If you
participate in our continuing education program, you may also provide your date
of birth, pharmacy license number, state of licensure, NABP e-Profile ID, and
NABP CE transcripts.
RxPharmacist
can receive such information in various ways through our Services, including:
•Account Registration: You share Personal
Information with us when you create an RxPharmacist account through our
website. Registered users can use login credentials to access online courses,
study materials, and other content and features offered by the Services.
•Course Purchases and Subscriptions: When
purchasing online courses, print study guides, or subscribing to RxPharmacist
services, including providing payment and billing information and, for print
orders, shipping information.
• Study Activity and User Performance Information:
When you access content on our platform, we collect information about the
practice tests you complete, your progression through RxPharmacist materials,
quiz scores, and lectures you have watched (collectively, “User Performance
Information”).
•Continuing Education Program: If you participate
in our CE program, you may provide your NABP e-Profile ID, date of birth,
pharmacy license number, state of licensure, and NABP CE transcripts. CE
transcript files uploaded for analysis are deleted after processing; the
resulting CE gap report data may be retained as described in Section 12 below.
• Newsletter and Marketing: When you subscribe to
our newsletter, request information, or otherwise opt in to receive marketing
communications from RxPharmacist, including through email list sign-up forms on
our website.
•Surveys and Feedback: RxPharmacist may receive
information about you in response to forms we post on our Services or send to
you, including for feedback and research purposes.
•Interactions: We receive information through
communications between you and us, such as via email, web form, or other
channels.
b. Information RxPharmacist
Receives from Third Parties
RxPharmacist
may receive Personal Information from third parties, including:
• Educational institutions, such as pharmacy schools that
direct students to use our Services or share information for score reporting
purposes;
•Social media platforms, when you engage with us or use
social media features; and
•Publicly available sources.
We may
combine the information we receive from these third parties with Personal
Information we collect directly from you and use it as described in this
Policy.
c. Information RxPharmacist
Receives Through Automated Means
When you use
RxPharmacist’s online Services, we receive certain technical information about
your use of the Services, and that may be associated with your Personal
Information in some instances. RxPharmacist collects technical information when
an individual visits our website, including IP address, browser type and
version, time zone settings, browser plug-in types and versions, operating
system and platform type.
We may also
collect information about the visit, including pages and content viewed or
searched for, page response times, download errors, length of visits to certain
pages, page interaction information, and methods used to browse to or away from
the page.
5. Cookies and Similar
Technologies
Our website uses “cookies” and other
commonly-used web technologies. A cookie is a small text file containing a
unique identification number that is transferred from a website to your
computer. This unique number identifies your web browser whenever you visit our
website.
Most web browsers are set to accept
cookies by default, but if you prefer, you can configure your browser to notify
you before accepting a cookie, or refuse to accept cookies altogether. While
RxPharmacist does not require you to use cookies, certain features of our
Services may not function properly if your browser refuses cookies.
6. How We Use Personal
Information We Collect
We use
Personal Information to operate, evaluate, and improve our Services, including
for the following purposes:
•Performance of our obligations arising from your
account registration, subscription, purchase, and any other agreement entered
into between you and us;
•To provide you with information, products and services
you request from us;
•To manage your account, course subscriptions, and
platform preferences;
•To facilitate score reporting and User Performance
Information sharing with educational institutions at your direction;
•To process and deliver continuing education services,
including generating CE gap reports from uploaded NABP CE transcripts and,
following ACPE accreditation, transmitting CE credit data to ACPE and NABP via
CPE Monitor as described in Section 7 below;
• To process and fulfill orders for print study guides,
including shipping;
•To respond to your questions and provide related
customer services;
•To tailor the content that we display to you in our
Services and communications, including information about study materials and
services that we believe may be of interest to you;
•For our business purposes, such as data analysis,
audits, developing new products and features, enhancing our website, improving
our products and services, identifying usage trends, and determining the
effectiveness of our promotional campaigns;
•To notify you about changes to your account or related
services or to ask you to provide feedback;
•To administer and protect our business and websites
(including troubleshooting, data analysis, testing, system maintenance,
support, reporting and hosting of data);
•To comply with all applicable laws, legal processes and
industry standards, our policies and our contractual rights, including ACPE
accreditation requirements where applicable; and
•For any other purpose specified at the point of
collection or as described in your express authorization.
7. How We Share and Disclose
Personal Information
RxPharmacist
will not disclose your Personal Information to third parties without your
consent except as described below:
a. Third Party Disclosures
We may
disclose information about you: (i) if we are required to do so by law or legal
process; (ii) when we believe disclosure is necessary to prevent harm or
financial loss; (iii) in connection with an investigation of suspected or
actual fraudulent or illegal activity; or (iv) under exigent circumstances to
protect the personal safety of our staff, users, or the public; and
b. Service Providers
We may
provide your Personal Information to companies that provide services to help us
with our business activities, such as our payment processor, website hosting
provider (WPEngine), email service provider, learning management system, and
customer support tools. These companies are authorized to use your Personal
Information only as necessary to provide these services to us and are
contractually obligated to maintain the confidentiality and security of your
information.
c.
Educational Institutions
User Performance Information may be disclosed to educational
institutions (e.g., your pharmacy school) and professors at your direction for
score reporting and coursework purposes. Such disclosures occur only at your
request or with your consent. To the extent your educational institution
collects and maintains User Performance Information, that information may
become an educational record under the Family Educational Rights and Privacy
Act (“FERPA”) in the hands of the school; RxPharmacist is not itself a FERPA-regulated
entity.
d. De-Identified and Aggregate
Data
We may share
de-identified or aggregate analytics data with product development partners for
the purpose of improving our Services and developing new products. Such data
does not identify individual users. Recipients of de-identified data are
contractually prohibited from attempting to re-identify any individual from
such data.
e. CE Credit Reporting (ACPE and
NABP)
Following
ACPE accreditation, when you complete an ACPE-accredited continuing education
activity through RxPharmacist, we will transmit your NABP e-Profile ID, date of
birth, and CE credit data to the Accreditation Council for Pharmacy Education
(ACPE), which transmits such data to the National Association of Boards of
Pharmacy (NABP) via CPE Monitor for the purpose of logging your CE credit. By
completing an ACPE-accredited activity, you consent to this transmission. This
sharing is at your direction for the purpose you registered for (obtaining
logged CE credit) and is not a sale of your Personal Information.
f. Business Transfers
In the event
that RxPharmacist is involved in a merger, acquisition, financing,
reorganization, bankruptcy, receivership, dissolution, sale of all or a portion
of our assets, or transition of a service to another provider, your personal
information may be transferred as part of such a transaction, as permitted by
law and/or contract. In such event, RxPharmacist will endeavor to direct the
transferee to use personal information in a manner that is consistent with this
Privacy Policy.
g. Sensitive Personal Information
RxPharmacist
does not knowingly collect health data, biometric data, precise geolocation,
financial account credentials, social security numbers, disability or
accommodations data, immigration status, or any other category of sensitive
personal information as defined under state privacy law, except for payment
information necessary to complete transactions you request and professional
licensing information (such as pharmacy license numbers and NABP e-Profile IDs)
collected solely for the purpose of delivering our CE and exam preparation
services. We do not disclose sensitive Personal Information except as necessary
to provide the Services you have requested, all under appropriate
confidentiality and security protections.
9. Your
Privacy Rights and Choices
a. General
Rights
Accessing
and Correcting your Personal Information. If you have an account with us,
you can generally access or correct your information by logging in to your
account. If you are unable to do so, or if you would like to request access to,
correction of, or deletion of your Personal Information, you can make a request
by contacting us at help@rxpharmacist.com.
Opting-Out
of Marketing Emails: From time to time, we may contact you via email for
the purpose of providing announcements, promotional information and/or other
general communication. You may choose not to receive marketing emails from us
by clicking on the unsubscribe link in the marketing emails you receive from
us. Please note that it may take some time for your request to be fully
processed.
Even if you
opt out of receiving such communications, we may continue sending you
non-marketing email communications, such as administrative or transaction
alerts, or information about changes to our terms of service.
b. Notice for Residents of
Certain States in the US
Certain
privacy laws may provide additional rights with respect to our collection and
use of personal information. Due to our size, operations, and nature of our
business, we may not be subject to any particular state’s privacy laws, but you
can submit such requests to us via the contact information provided below and
we will endeavor to fulfill any obligations that are legally required,
otherwise we will respond to such request in our discretion. Such states may
provide rights such as to: (i) disclose personal information maintained about
the individual; (ii) collect or delete personal information maintained about
the individual (subject to certain exceptions); (iii) not sell personal
information about the individual to a third party (excluding qualified service
providers); and (iv) not engage in third party targeted advertising. We do not
engage in impactful profiling activities with respect to a user’s personal
information, use sensitive personal information except for the reasons provided
and do not generally provide a financial incentive in return for the collection
or use of personal information (except where disclosed with relevant terms at
the time of collection). We do not share personal information to third parties
for their own direct marketing purposes. It can be unlawful to discriminate
against an individual for exercising such rights.
RxPharmacist
does not sell your personal data to data brokers or marketers, does not rent or
license your personal data to third parties, and does not use your personal
data for cross-context behavioral advertising. We do not share your text
message program enrollment or consent with third parties for their own
purposes.
c. Do
Not Track and Browser Signals
Do Not Track
(DNT) is a privacy preference you can set in most browsers but there is no
standard interpretation or practice for responding to DNT signals, and
RxPharmacist therefore handles all user information consistent with this
Policy. RxPharmacist does not sell or share personal data.
10. Third
Party Links
Our Services may contain links to other websites or platforms, including
without limitation social media platforms and other third party services. We
are not responsible for the privacy practices of such other sites. We encourage
our users to be aware when they leave our Services and to read the privacy
policy of each and every website they visit. This Privacy Policy applies only
to information collected by RxPharmacist through its Services.
11. Data Minimization
RxPharmacist
limits its collection of Personal Information to what is reasonably necessary
and proportionate to the purposes disclosed in this Policy. We regularly review
our data collection practices to ensure they remain aligned with this
principle.
12.
Security and Retention of Personal Information
We maintain
reasonable administrative, technical, and physical safeguards designed to
protect Personal Information in our possession and control from loss, misuse,
and unauthorized access, disclosure, alteration, or destruction. However, we
cannot ensure the security of any information that you transmit to us, or
guarantee that this information will not be accessed, disclosed, altered, or
destroyed. We will make any legally required disclosures in the event of any
compromise of Personal Information consistent with applicable state breach
notification laws. To the extent the law allows us to provide such notification
via email or conspicuous posting on the Services, you agree to accept notice in
that form.
You are
ultimately responsible for the security of your RxPharmacist login credentials.
You may not share your RxPharmacist login credentials with others so they can
access content or features that are restricted to your account. You should log
out of your browser at the end of each computer session to ensure that others
cannot access your Personal Information and correspondence, especially if you
share a computer with someone else or are using a computer in a public place
like a library or Internet cafe.
We apply a
general rule of keeping Personal Information only for as long as required to
fulfill the purposes for which it was collected. For non-CE content, we retain
User Performance Information for three (3) years following your last login or
course expiration, after which data is deleted or de-identified. For continuing
education records, following ACPE accreditation, we retain CE activity and
participant records for a minimum of six (6) years as required by ACPE
accreditation standards. We may also retain information as reasonably necessary
for legal, tax and accounting requirements, or if required to do so by a legal
process, legal authority, or other governmental entity having authority to make
the request, for so long as required.
13. Minors
Our Services
are intended for users who are 18 years of age or older. We do not knowingly
collect or maintain Personal Information from individuals under the age of 18.
If we learn that Personal Information of an individual under 18 years of age
has been collected on or through our Services, we will take appropriate steps
to delete this information. If you are a
parent or guardian and discover that your child has provided us with Personal
Information, please contact us as directed below to request that we delete the
information from our systems.
14.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes
in our practices, technologies, legal requirements, or other factors. When we
make material changes, we will revise the “Effective Date” at the top of this
Privacy Policy and post the updated version on our website. We encourage you to
review this Privacy Policy periodically to stay informed about how we are
protecting your information.
Your continued use of our Services after any changes to this Privacy
Policy constitutes your acceptance of the updated policy.
